GENERAL TERMS AND CONDITIONS OF E-MODA.CO.UK

These General Terms and Conditions ("Terms") are issued by E-Moda Ltd. and have been adapted to comply with the applicable laws and regulations of the United Kingdom, including the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the Consumer Rights Act 2015, and the Electronic Commerce (EC Directive) Regulations 2002.
ARTICLE 1 - DEFINITIONS
In these Terms, the following terms shall have the meanings set out below:
Cooling-off Period: The period during which the consumer may exercise the right to cancel.
Consumer: A natural person not acting in a professional or business capacity who enters into a distance contract with the trader for the purchase of a product.
Day: Calendar day.
Third Party: Any person or entity appointed by the consumer to receive the product.
Digital Content: Data produced and supplied in digital form.
Durable Medium: Any device (including email, SMS, WhatsApp) that allows the consumer or trader to store information addressed to them personally for future reference for a period suitable to the purpose of the information.
Electronic Means: Transmission via digital channels such as email, SMS, or WhatsApp.
Right to Cancel: The consumer’s right to withdraw from a distance contract within the cooling-off period.
Trader ("E-Moda"): The company offering products for sale via the Site.
Distance Contract: An agreement concluded between E-Moda and the consumer as part of a structured system for selling products at a distance.
Product: A tangible good offered by E-Moda.
Breach of Contract: Failure by either party to fulfil agreed obligations.

ARTICLE 3 - APPLICABILITY These Terms apply to all offers from E-Moda and to any distance contract concluded between E-Moda and the consumer.
Prior to the conclusion of a distance contract, the text of these Terms shall be made available. If not possible, the consumer shall be informed of how to access them electronically or upon request free of charge.
If a distance contract is concluded electronically, E-Moda may supply the Terms in a format that allows the consumer to store them on a durable medium.
Where additional product or service conditions apply, the consumer may rely on the most favourable provisions in the event of inconsistencies.
ARTICLE 4 - THE OFFER
Offers are valid for a limited time if explicitly stated.
Descriptions and images are accurate and detailed enough to assess the offer. Obvious errors do not bind E-Moda.
All offers include clear information about rights and obligations, including pricing and cancellation policies.
ARTICLE 5 - THE CONTRACT
A contract is formed once the consumer accepts the offer and meets the stated conditions.
Upon electronic acceptance, E-Moda will confirm receipt without undue delay.
E-Moda ensures secure data transfer and payment options.
E-Moda may verify a consumer’s ability to pay before accepting an order.
The consumer will receive order details, including return rights, customer support info, total price (including taxes and delivery fees), and a cancellation form, via email.
ARTICLE 6 - RIGHT TO CANCEL
The consumer has a right to cancel the purchase of physical goods within 14 days without giving any reason.
The cancellation period begins the day after the consumer or a designated third party receives the goods.
For multiple items: from the day the last item is received.
ARTICLE 7 - CONSUMER OBLIGATIONS DURING COOLING-OFF PERIOD
Consumers must handle goods with care, inspecting them as they would in a shop.
The consumer is liable for any diminished value resulting from handling beyond what is necessary.
ARTICLE 8 - EXERCISING RIGHT TO CANCEL
Consumers must notify E-Moda via the return form or email.
Items must be returned within 14 days from notification.
Returns must include original packaging where possible and be sent with a track & trace code.
Consumers bear the cost and risk of return unless otherwise agreed.
ARTICLE 9 - TRADER OBLIGATIONS UPON CANCELLATION
E-Moda confirms receipt of cancellation electronically.
Refunds, including standard delivery charges, are issued within 14 days of cancellation notice.
Refunds may be withheld until returned goods are received.
Refunds use the original payment method unless otherwise agreed.
ARTICLE 10 - EXCLUSIONS FROM THE RIGHT TO CANCEL
E-Moda excludes returns for:
Sale items.
Items returned after 14 days.
Worn/used items or those with tags removed.
Items with odours, makeup stains.
Intimate wear (e.g., underwear, swimwear).
Jewellery (including personalised items).
Cosmetics and makeup.
ARTICLE 11 - PRICING
Prices are fixed during offer period, except for VAT changes.
Variable pricing may apply for items affected by financial market fluctuations.
Full prices include VAT.
ARTICLE 12 - CONTRACT PERFORMANCE
Products must match descriptions and conform to legal requirements.
Trader guarantees suitability for agreed use.
ARTICLE 13 - WARRANTY
Any additional manufacturer’s warranty does not affect statutory rights.
Warranty covers issues not arising from consumer misuse.
ARTICLE 14 - DELIVERY
Delivery address is as indicated by the consumer.
Orders are dispatched within 30 days unless otherwise agreed.
In case of delay, the consumer may cancel and request a refund.
Risk transfers upon receipt by the consumer.
ARTICLE 15 - CONTRACT DURATION & TERMINATION
For indefinite contracts involving periodic deliveries, consumers may cancel with 1-month notice.
Cancellation methods must be as easy as the subscription method.
ARTICLE 16 - PAYMENT
Payments are due immediately unless otherwise agreed.
Advance payments may not exceed 50% unless explicitly agreed.
Consumers must notify E-Moda of payment errors promptly.
Late payments incur statutory interest and reasonable collection costs, capped according to UK practice.
ARTICLE 17 - COMPLAINTS
Complaints must be submitted within a reasonable time.
E-Moda responds within 14 days or notifies of longer processing time.
Consumers must allow E-Moda 4 weeks to resolve complaints before escalation.
ARTICLE 18 - DISPUTES
These Terms are governed by English law.
Disputes may be submitted to a UK court with appropriate jurisdiction.
ARTICLE 19 - ADDITIONAL TERMS
Additional provisions may not conflict with consumer rights and must be available in a durable format.

Items Not Eligible for Return:
Sale items.
Returns received after 30 days.
Items not in original condition (tags missing, worn, scented, stained).
Intimate apparel, jewellery (incl. personalised), makeup, bras, and underwear.
